Terms of Service
Effective April 29, 2026
Agreement
These Terms govern your use of the Kiteview platform, including the website at kiteview.co, the API, and the Kiteview browser extension (collectively, the “Service”). The Service is provided by Kiteview, Inc. (“we,” “our”). By creating an account or installing the extension you agree to these Terms.
Your account
You must be at least 18 to use the Service. You are responsible for keeping your credentials and API keys secure. You may not share your account with others outside your organization. If you sign up on behalf of a company, you confirm you have authority to bind that company to these Terms.
Acceptable use
You agree not to:
- Use the Service to scrape, redistribute, or compete with the Service itself.
- Track competitors in violation of those competitors’ terms of service or applicable law.
- Reverse-engineer the Service except as expressly permitted by law.
- Use the Service to harass, defame, or harm anyone.
- Attempt to gain unauthorized access to other accounts or to our infrastructure.
- Use the Service to generate spam, phishing content, or other malicious material.
We may suspend or terminate accounts that violate these rules.
Subscriptions and billing
Paid plans are billed in advance, monthly or annually, in US dollars. You can upgrade, downgrade, or cancel at any time from Settings → Billing. Cancellations take effect at the end of the current billing period. Upgrades take effect immediately and Stripe prorates the difference. Downgrades are scheduled for the end of the period without proration.
We do not refund partial periods unless required by law or unless the cancellation is the result of a material defect we could not fix within a reasonable time.
Some plans include metered Argus usage that exceeds the weekly cap. When enabled, additional Argus queries are billed in arrears at the per-query rate displayed in your Settings → Usage panel; you can set a monthly hard cap there. Bulk credit packs (where available on your tier) are non-refundable once consumed and expire if your account is deleted.
AI-generated content
Argus and the rest of the platform produce briefs, forecasts, and recommendations using third-party large language models. These outputs are starting points for your judgment, not professional advice. You are responsible for verifying any specific claim before acting on it, particularly when the output identifies a third party or describes their plans. Kiteview does not warrant that AI outputs are accurate, complete, or fit for a particular purpose.
We log the AI calls we make on your behalf (route, model, token counts, cost) for billing transparency and to improve our prompts. See our Privacy Policy for retention details.
Your data
You retain ownership of all competitive intelligence, briefs, ratings, and other content you create or upload to the Service. You grant us a limited, non-exclusive license to host, store, and process that content solely to operate and improve the Service for you. We do not use your content to train third-party models.
Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted access. We perform periodic maintenance and will give reasonable notice for planned downtime when feasible. If you are on a paid plan and the Service experiences extended unplanned downtime, contact support and we’ll work with you on a credit.
Disclaimers
The Service is provided “as is.” Competitive intelligence is generated in part by automated systems (web scrapers, language models). We do our best to keep it accurate, but you should independently verify critical facts before acting on them. We disclaim all implied warranties to the extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability for claims arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100. We are not liable for indirect, consequential, or special damages.
Termination
You can cancel your account at any time. We can suspend or terminate your account if you violate these Terms or if we are required to by law. On termination we will delete your data in line with the timelines in our Privacy Policy.
Changes
If we materially change these Terms we’ll notify registered users by email at least 7 days before the changes take effect. Continued use of the Service after that date means you accept the new Terms.
